Terms of Service

Treasure Map provides a collaborative canvas tool that allows product teams to visually map problem spaces, create and organise circles on a shared canvas, and share the output with colleagues and stakeholders.

The service is currently in beta. Features may change, and we may introduce, modify, or discontinue functionality at any time.

You must be at least 16 years old to use Treasure Map. By creating an account you confirm that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

If you are using the service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

You are responsible for keeping your account credentials secure. You must notify us immediately if you suspect unauthorised access to your account. We are not liable for any loss resulting from someone else using your account without your knowledge.

One person or legal entity may not maintain more than one free account. Free accounts are for personal or small-team use and may not be used to circumvent paid plan limits.

Treasure Map offers a free tier and paid plans (“Team” and “Studio”). Paid plans are billed in advance on a monthly or annual basis via Stripe. All prices are in USD unless otherwise stated.

Free trial. Paid plans may include a free trial period. At the end of the trial, your card will be charged automatically unless you cancel before the trial ends.

Cancellation. You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period; you retain access until then. We do not offer refunds for partial billing periods except where required by law.

Price changes.We may change plan prices with 30 days' notice. Continued use after the effective date constitutes acceptance of the new price.

Taxes. Prices shown are exclusive of applicable taxes (GST, VAT, etc.). Stripe Tax calculates and collects applicable taxes at checkout based on your location.

You agree not to use Treasure Map to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Upload or transmit malware, spam, or other harmful content
• Attempt to gain unauthorised access to another user's account or data
• Reverse engineer, decompile, or otherwise attempt to derive source code from the service
• Use automated scripts to scrape, crawl, or excessively load the service without our prior written consent
• Resell or sublicense access to the service without our prior written consent

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice, at our sole discretion.

You retain ownership of the canvases, circles, labels, and other content you create in Treasure Map (“Your Content”). By using the service you grant us a limited licence to store, process, and transmit Your Content solely to provide the service to you and your collaborators.

You are responsible for ensuring that Your Content does not violate any law or third-party rights. We do not pre-screen content but reserve the right to remove content that violates these Terms.

We will not use Your Content to train machine-learning models or share it with third parties except as required to provide the service (e.g. infrastructure providers) or as required by law.

The Treasure Map name, logo, software, and all associated materials are our intellectual property or that of our licensors. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

We aim to keep Treasure Map available but do not guarantee any specific uptime. The service is provided “as is” and “as available”. We may perform scheduled or emergency maintenance that temporarily interrupts access.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free, secure, or uninterrupted.

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to these Terms or the service is limited to the amount you paid us in the 12 months preceding the claim, or NZD $100, whichever is greater.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of business, even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes liability that cannot be excluded under applicable New Zealand law, including liability under the Consumer Guarantees Act 1993 where it applies.

You agree to indemnify and hold us harmless from any claims, losses, damages, and expenses (including legal fees) arising from your use of the service, Your Content, or your violation of these Terms or any applicable law.

You may stop using the service and delete your account at any time. We may suspend or terminate your account if you breach these Terms, fail to pay applicable fees, or if we decide to discontinue the service.

On termination, your right to access the service ceases immediately. We will retain your data for 30 days to allow for account recovery, after which it will be deleted in accordance with our Privacy Policy.

These Terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

We may update these Terms from time to time. When we make material changes we will update the date at the top of this page and notify you by email at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.
